May 2016 L-Blast: Preparing for DOL’s Notice of Proposed Rulemaking | Positioning HR to Excel for Tomorrow’s Strategic Imperatives

Dear Friends,
With summer coming up soon, it’s hard to think about December deadlines. However, with the recent regulation updates from the U.S. Department of Labor (DOL), you may need to start planning for compensation changes while planning summer vacations.

We have two very important articles for you this month. The first one highlights DOL’s announcement this week, which detailed its updates to overtime pay regulations. DOL received more than 270,000 comments in response to the Notice of Proposed Rulemaking (NPRM) from a variety of interested stakeholders.
Our article explains the changes and what employers may need to do before the December effective date.
The specific actions items are:

  • Re-evaluate the exempt status of current employees
  • Evaluate job descriptions to ensure they comply with any revisions
  • Revise overtime policies
  • Review the company policies regarding “off the clock” or after-hours work, such as reading/responding to emails
  • Review payroll and/or time and attendance systems to ensure it can accurately track hours and calculate overtime

The second article shares a recent presentation both my partner, Chris Crawford, and I conducted. We had the opportunity to speak at the Gulf Coast Symposium this month in Houston, where we presented “Positioning HR to Excel for Tomorrow’s Strategic Imperatives.” Within this presentation, we explore the dynamics of four separate and distinct generations currently in the workplace, and how they view work so differently. We show the impacts of these different generations on employer initiatives. The Gulf Coast Symposium always does an excellent job providing a gateway to learn and hone HR skills. We welcome any thoughts, input, and/or questions on this presentation.

Finally, we plan to debut a research study within the next two weeks. In light of the ongoing volatility in the energy sector, as well as the upcoming end of the spring proxy season, we thought it would be beneficial to put together a synopsis of changes in energy company pay in 2015 and 2016.
